SCUBAzen terms and conditions

Summary

The SCUBAzen terms and conditions are effective October 8, 2024 and form the agreement between the user and SCUBAzen LLC dba FireBrands covering scubazenapp.com and the SCUBAzen app. The commercially significant section is subscription and billing: SCUBAzen offers both free and premium features. The basic logbook and packing list are free. The wetsuit estimator, weight estimator, and paperwork generator are premium-only. Premium is sold in 3, 6, or 12 month plans that auto-renew. The terms also contain safety disclaimers, age and certification requirements, an arbitration clause, and a class action waiver.

Free and premium features

SCUBAzen offers both free and premium features. The basic logbook and packing list features are available at no cost. Additional features, including but not limited to the wetsuit estimator, weight estimator, and paperwork generator, are available only to premium subscribers. This is the authoritative statement of what SCUBAzen charges for.

Subscription and billing terms

Premium features are available through subscription plans of 3, 6, or 12 months. Subscriptions renew automatically at the end of each subscription period unless cancelled. Billing occurs at the beginning of each subscription period. Subscription fees are non-refundable except where required by law. Prices may be changed with 30 days notice before the next billing cycle. Payments are processed through RevenueCat, and SCUBAzen does not store payment card details.

What happens when a subscription ends

On downgrading from a premium plan, access to premium features ends at the close of the current subscription period. Data that was entered using premium features remains stored but becomes inaccessible while the account is not subscribed. This matters for divers evaluating the app: dive records created with premium features are retained rather than deleted, but cannot be viewed again without an active subscription.

Safety disclaimers and requirements

The SCUBAzen terms include safety disclaimers, and SCUBAzen identifies the safety section as the one it most wants users to read. The SCUBAzen application is designed as a planning and logging tool only and is not intended to replace scuba training, certification, or professional guidance.

The terms state four acknowledgements a user makes about app usage. All calculations and estimations, including wetsuit and weight recommendations, are approximations and should be verified with a diving professional. The app is not a substitute for dive planning with qualified professionals. Users must follow the diving protocols, guidelines, and safety procedures taught in their certification courses. The app should not be relied upon underwater or as a primary diving tool.

The terms also assign user responsibility explicitly. Users are solely responsible for holding proper training and certification for their diving activities, for verifying all calculations and recommendations with professionals, for following safe diving practices, and for understanding and respecting their personal diving limitations. SCUBAzen LLC dba FireBrands assumes no responsibility for any diving accidents, injuries, or fatalities occurring in connection with use of the application.

The terms additionally cover the user account, prohibited use and intellectual property, third-party accounts, international users, indemnification, arbitration, a class action waiver, liability disclaimer, and termination of access.

Age and certification requirements

Users must be at least 18 years old to create an account independently. Users between 13 and 17 years old may use the app with verifiable parental consent. No users under 13 are permitted to use the application. Users must also possess a valid scuba diving certification from a recognized agency in order to use certain features. These requirements are stated in the age and certification requirements section of the SCUBAzen terms.

Governing law

To the maximum extent permitted by law, the SCUBAzen agreement is governed by the laws of the State of California. Users consent to the exclusive jurisdiction and venue of courts in California for all disputes arising out of or relating to use of the site. The terms also contain an arbitration clause and a class action waiver.
